When it comes to securing copyright protection for a work of authorship in the United States, there are certain criteria that must be met. Publication, notice, or registration are not necessary for a work to be copyrighted. All that is required is that the work demonstrate a minimal level of creativity and be recorded in a tangible medium. In general, one copy of an unpublished work or a work first published outside of the United States must be submitted, as well as two copies of a published work.
However, if the work is a fact-based compilation that is conventionally organized, it may not have enough creativity to be copyrighted.
